Terms of Service

1. Acceptance of Terms

By creating an account or using OBiMS in any way, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not access or use the platform.

2. Description of Service

OBiMS is a cloud-based, multi-tenant business management platform that provides tools for sales management, purchasing, inventory tracking, VAT reporting, and financial analytics. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You must be at least 18 years old to create an account.
  • You may not share your account or allow others to access it on your behalf without authorisation.
  • You must notify us immediately of any unauthorised use of your account.

4. Acceptable Use

You agree not to:

  • Use OBiMS for any unlawful purpose or in violation of any applicable regulations.
  • Attempt to gain unauthorised access to any portion of the platform or its infrastructure.
  • Upload or transmit malicious code, viruses, or any harmful content.
  • Interfere with or disrupt the integrity or performance of the platform.
  • Reverse-engineer, decompile, or disassemble any portion of the software.

5. Your Data

You retain full ownership of all data you enter into OBiMS. By using the platform, you grant us a limited licence to store, process, and display your data solely for the purpose of providing the service. We will never sell or share your business data with third parties except as required to operate the platform (see our Privacy Policy).

6. Subscription & Payment

Certain features of OBiMS require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with at least 30 days' notice.

7. Intellectual Property

OBiMS and all associated software, designs, logos, and content are the exclusive property of Opal Systems. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials without our express written consent.

8. Disclaimer of Warranties

OBiMS is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Opal Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of OBiMS, even if we have been advised of the possibility of such damages.

10. Termination

We may suspend or terminate your account at any time if you breach these Terms. You may cancel your account at any time from your account settings. Upon termination, your data will be retained for 30 days before deletion.

11. Governing Law

These Terms are governed by the laws of the Republic of Malawi. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malawi.
